Summary

The article analyzes the grounds for the execution and serving of criminal penalties, which are identified in the current criminal-law enforcement legislation of Ukraine, identifies the problematic issues arising in the criminal activity of the personnel of the organs and penal institutions in this area, as well as scientifically substantiated measures for their Solution in essence.

This approach has theoretical (in view of expanding the content of doctrinal provisions on the rule of Law principle) and the applied meaning. In any case, its implementation in practice will fully reflect the level of normative technique, of the functions of rule-making realization and of interconnection and interaction of its principles in this activity. The main of them is the principle of systemicity, according to which all normative legal acts must be logically sequential, coordinated and balanced. This means, that, while creating them, the systemic properties of legislation shoul be taken into account.
