The article deals with the analysis of the correlation between the processes of lawmaking and enforcement. The article points a number of factors that determine poor law enforcement. The role and importance of the application of law as a special form of law realization along with lawmaking is determined. The legitimate influenza of jurisprudence on lawmaking through the exercise of the right of legislative initiative is considered.
An important place is given to enforcement policy. It is emphasized that this issue is poorly understood. The content of this policy is multifaceted. This includes:
– elaboration of goals and principles of law enforcement activities;
– determination of state priorities;
– general management;
– performance criteria;
– forms and methods of individual-power activity;
– terms of guarantees of rights and freedoms;
– publicity and more.
The general orientation and content of the enforcement policy are determined by the regulations. Enforcement policy is a guarantee of strengthening the rule of law and legislation, the protection of rights and freedoms.
The conclusion is made that that in order to increase the efficiency of implementation of legal norms, it is necessary to make timely changes and to differentiate functions between public authorities. Certainly, the priority for improving the effectiveness of the application of certain legal norms are the interests of the individual. Acting as a legal technology to satisfy these interests, the mechanism of legal regulation must be socially valuable in its nature, create a regime to promote the legitimate aspirations of the individual, strengthening its legal status.
For operational enforcement, it is important that the legislator desires to be guided by the following criteria:
– changes made to legal norms should not contradict current legislation;
– taking into account the needs of a rule of law;
– the will of state bodies is taken into account;
– timely elimination of gaps in the right.
