ОN THE ISSUE OF THE PERSONNEL SOCIAL PROTECTION OF CRIMINAL AND EXECUTIVE SERVICE OF UKRAINE

Summary:

The article is dedicated to the analysis of some problematic issues of social protection of the personnel of penal bodies and institutions and their reflection in the national legislation of Ukraine. It is determined that exactly inappropriate level of social and legal protection, insufficient level of legal competency of the personnel leads to the selection of unskilled workers, both from junior inspectors and from the officer’s staff. That accordingly leads to violations in the performance of their duties.

In the process of analyzing recent researches of the scholars, concerning the adequacy of national legislation in the field of execution of punishment and serving a sentence, materials of prosecutorial and journalistic investigations, the results of inspections of an ombudsman and international legal organizations, we can conclude that the condition of social protection of the personnel of the State Criminal and Executive Service of Ukraine not only doesn’t match the level of European countries, but brings Ukraine closer to the countries that have just started to develop their legislation in this area. The personnel of the State Criminal and Executive Service of Ukraine is the main force which has a great role to re-socialize the convicts in society as lawful citizens. It carries out duties of great social importance that is execution of criminal punishment, in relation to persons who committed the most dangerous social acts – crimes. This work is connected with constant stress, losing of emotional and physical strength, overloading, emotional tension. Sometimes, the personnel may face some extreme conditions of service, such as: group protests of convicts, mass riots, a high probability of an increased threat to the lives and health of the personnel as a result of prisoners’ aggression. All this causes the necessity in additional measures in order to increase the interest in working with convicts.

Consequently, the Criminal and Executive Service requires the recruitment of skilled workers of different professions, mainly lawyers, psychologists, teachers, but in condition of appropriate social protection of the personnel of the State Criminal and Executive Service of Ukraine by the state.
