The article is devoted to the analysis of the essence and content of fiction in the Criminal Code of Ukraine, namely the fictions of the institute of crime recidivism. The analysis of normative legal acts, views of scientists on the problem of fictitious norms was carried out.
The article points out that the new rules for the appointment of punishment in case of relapse led to the loss of the criminal legal significance of the distribution of relapse to species. This means that the legal regulation of recidivism and related standards requires the creation of a clearer regulatory framework, which will allow more effective resolution of the problems of applying the norms providing for responsibility for the recurrence of crimes in the law on criminal liability.
