Summary

In the article the author discusses the issue of nonconformity of the national legislature with the European standards of health care in penal institutions.

The author researches the specific work of medical institutions in penal institutions and peculiarities of providing convicts with health care services having the work of penal institutions in France as an example.

The author analyzes the organization of health care services in Ukraine and the Frеnch Republic. Specifically, the medical staff in France are not subordinate to the authorities. They are not to report to the penal institution authorities . In France a convict can see any medical officer at any time or day without allowance of the institution authorities. The author pays attention to the different approach to the rehabilitation of convicts who suffer from tuberculosis.

The author comes to the conditions that the European experience in providing health care services in penal institutions ensures the individual approach to health care. The national legislation is limited by the general rules that are not flexible and do not give the opportunity to provide individual care for convicts taking into account the real conditions. That’s why, at present the provisions that regulate health care in the national legislation don’t correspond to the demands of the international legal acts and don’t guarantee convicts’ rights to proper health care services.
