CRIMINAL AND LEGAL PROTECTION OF INDEPENDENCE OF THE JUDICATURE IN UKRAINE: REQUIREMENTS OF TODAY

Summary:

The requirements of today regarding criminal protection of the independence of the judicature in Ukraine are revealed in the article. It is emphasized that at the present stage of building the state governed by the rule of law and reforming public authorities, Ukraine should be a European state, have appropriate bodies and institutions of civil society that are able to ensure the integrity of the state today, comply with the requirements of the law, not infringe on citizens’ rights and freedoms and legitimate interests.

One such body is the court and its judicature, which consists of more than eight thousand professional specialists empowered by the state to exercise special public powers. It is protected by the legislation on criminal liability, which ensures their independence to administer justice in Ukraine through criminal law protection.

It is noted that public opinion about the state’s inability to protect its democratic foundations is gradually emerging in Ukraine today. And this fact worries the public, because if the state and its institutions, including the judicial system, remain unable to counter criminal acts against them effectively, any assurances of its ability to protect citizens’ rights and legitimate interests will be unconvincing.

The increased attention of public and state institutions to the activity of the judicial system in conditions of democratic development of Ukrainian society, its adaptation to European standards of justice is emphasized.

According to the results of considering criminal protection of the independence of the judicature in Ukraine through the prism of a new Code of Criminal Procedure of Ukraine and the Law of Ukraine “On the Judiciary and Status of Judges” it is concluded that it is impossible to build a democratic, social and governed by the rule of law state without independent and impartial justice.
