DEPRIVATION OF THE RIGHT TO TAKE UP CERTAIN POSTS OR TO BE ENGAGED IN CERTAIN ACTIVITY IN THE CLASSIFICATION OF PUNISHMENT

Summary

The problematic issue of assigning the right to occupy certain positions or engage in certain activities to certain types of punishment, depending on the criteria for their classification, is investigated. This problem has a great theoretical and practical significance, since both the above and other possible classification of the deprivation of the right to occupy certain positions or engage in certain activities will promote the maximum individualization of punishment, the correct establishment of the grounds, the order and limits of its application, the identification of those features of the appointment of this type of punishment , Which should be taken into account by the court when it is applied.

 “Deprivation of the right” refers to special punitive forms of punishment that can be applied both as basic and as additional, not connected with imprisonment and with restrictions of property character. It is aimed at limiting the right to work and as the main punishment can be imposed only in cases provided for in sanctions norm, as an additional in cases where it does not provide for sanctions norm of the special part of the Criminal Code. It can be appointed for incompletely-elderly only as an additional punishment.
