Summary

The article deals with the nature of discipline, disciplinary responsibility of Criminal and Executive Service personnel and scientific grounds of activities, which may have positive impact on improvement of service within the system. The factors that improve the state of legality and discipline of the ordinary and commanding staffl in the criminal and executive service of Ukraine are outlined in the article. The author comes to conclusion that disciplinary responsibility may be analyzed in both positive and negative aspects; reason for it may be disciplinary, administrative or moral offence; administrative responsibility may be used along with other forms of legal responsibility.

It should be mentioned that regardless of the fact, which act is in the basis of disciplinary liability of Criminal and Executive Service ordinary and commanding staff, it is characterized by a number of general elements, namely: disciplinary responsibility is a two-dimensional one (positive and negative); it is based on disciplinary, administrative or moral misdemeanor; for such a misdemeanor it is provided an imposition of a disciplinary penalty under the formula: one offense – one penalty; the penalty is applied by an authorized body (official) in order of subordination; the limits of the disciplinary authority of these bodies (officials) are established by legal norms; disciplinary liability can be applied in conjunction with other types of legal liability.
