THE PROBLEMS OF THE DEFINITION OF CRIMES AGAINST HEALTH IN THE DOMESTIC LEGISLATION

Summary

In the paper, the problems of the terminological apparatus are examined when comparing the norms of the current Criminal Code of Ukraine of 2001 with the provisions of the by-law – «The Rules for Forensic Medical Determination of the Severity of Bodily Injuries» approved by the order of the Ministry of Health of Ukraine No. 6 in 1995. The analysis of the signs of bodily injuries has been carried out and its own vision regarding the improvement of the law on criminal responsibility, namely crimes against human health, provided for in Part II of the Special Part of the Criminal Code of Ukraine.

Consequently, the study of modern Ukrainian legislation on the signs of bodily harm shows that subordinate regulations in this area are not in full compliance with the provisions of the current Criminal Code of Ukraine.

We believe that the legal criteria for serious bodily injuries in the Rules of court and medical determination of the degree of bodily injuries gravity from 1995 should be in the highest rank appropriate to the disposition of Article 121 of current Criminal Code of Ukraine. This also applies to dispositions of other articles on crimes against human life and health.
